An employee should not be discriminated because of his age. The employer should determine the person by his qualification and skills and not by his/her age. The employer think that it is easy to give training to younger staff as they are fresh and can be molded in any way the employer like than the old employees as they will have a determined mind. Moreover the older employees are costlier than the younger ones. If you are a 55 year old person and you have been dismissed out of your job because of your age and have been replaced by a younger employee it is also a kind of discrimination for which you can file a case against the employer by appealing in EEOC To protect as well as preserve the elder senior workers from any of the malpractices or injustice and also mainly to make sure that same opportunity as others is given to them is enacted in the employment act. If a job requires very hard physical work the employer can set age limits for that job alone because the older ones will not have that much stamina to withstand the tiring work. In such cases age discrimination is not unlawful.
