Filing A Complain With the EeocFiling A Complain With the Eeoc The EEOC (EQUAL EMPLOYMENT OPPURTUNITY COMMISSION) a Federal Agency is authorized to settle claims of illegal discrimination. One can approach the EEOC for job discrimination based upon race, sex, national origin, religion, age or disability. Any one who is the victim of discrimination can file a case against a person or group of persons. The State Government can determine the number of days for filing a discrimination act. It is usually set to 180 days. The exact date, the name of the employer and also the details of the person filing the case should be given in the application form.
After receiving the complaint the EEOC will take action against the employer. The employer cannot take any action against the employee for lodging the compliant with the EEOC. The EEOC will commence the investigation and it includes the examination of written files, request for information, interview and also a visit to the site of the said discrimination. If the EEOC comes to conclusion that a particular person is affected by the employer and has violated the labor, it will try to request the employer to come to a settlement with the employee or it will sue the employer in court. In case the EEOC is not able to settle the case amicably then it will quit the case and a “Right to sue” letter is given to the victim. Within 90 days of receiving such letter the employee can then go to court and can appoint a private attorney. Or else if the EEOC itself files a suit then it has the full rights as a private lawyer. So in case, any discrimination is found then it is always better to approach EEOC and take actions as per law.
